Long before the privacy rules were enacted, HIPAA portended complex rules governing enrollment, portability, and nondiscrimination in health plans. The fact is, even though privacy issues have significantly overshadowed the other requirements of HIPAA, there can be serious consequences to a health plan that violates these other rules. As with any law of this nature, real life situations can create perplexing compliance problems. Fortunately, the Department of Labor has published valuable guidance that outlines what they are looking for when they audit a plan sponsor for compliance with the HIPAA portability rules. This webcast will examine the DOL guidance and address the common questions that health plan sponsors typically face in trying to apply the technical requirements in daytoday situations. Questions like . . . Is the insurance company or the employerplan sponsor responsible for providing certificates of creditable coverage? And, what are the commonplace situations in which certificates prepared by an insurance company are not in compliance with the requirements? If a child is born into an employees family, can the employee enroll the child and his or her spouse in the health plan under the special enrollment rules? What if the parents are not married? Is loss of military coverage a HIPAA special enrollment event? Will a plan violate HIPAA nondiscrimination rules if it provides a discount for nonsmokers? What if it excludes coverage for injuries that are sustained while participating in dangerous activities? Can a plan still have an "activelyatwork" clause for health care plan eligibility? How and when are certificates of creditable coverage required to be provided? Which employersponsored group health plans are exempt from the HIPAA portability provisions (but not the privacy provisions)? What are the four HIPAA portability notice requirements? What documentation must a plan sponsor maintain to prove compliance with the HIPAA portability requirements, including the notice requirements? What if an individual was not provided with a certificate of creditable coverage (or lost it)? Under what circumstance can an individual go from group coverage to individual coverage without imposing a preexisting condition limitation or other underwriting requirements?
